Is my car insurance valid with an expired MOT?
Almost certainly not — if you make a claim. Your policy technically remains active, but most insurers will reject a claim if the vehicle was being driven without a valid MOT at the time. The consequences can be serious and expensive.
What the insurance small print actually says
Standard UK car insurance policies include a requirement that the vehicle is roadworthy and legally compliant. An MOT certificate is the government's confirmation that your car meets minimum roadworthiness standards. Without one, you are in breach of that policy condition.
This doesn't mean your policy is automatically cancelled — your insurer won't necessarily know until you make a claim. But at the point of a claim, they have grounds to investigate and, if they discover the MOT had lapsed, to refuse the payout entirely.
Serious risk: Even third-party liability cover — which pays out if you injure someone or damage their property — can be affected. If your insurer refuses to cover a third-party claim, they may pay it out initially but then recover the cost from you personally. This can run to tens of thousands of pounds.
How does this play out in practice?
Will the police know my MOT has expired?
Yes. Police automatic number plate recognition (ANPR) cameras check vehicles against the DVSA and DVLA databases in real time. An officer can see within seconds whether your MOT is valid. You can be issued a fixed penalty notice of up to £1,000 on the spot, and the vehicle can be seized.
The legal exception: You can legally drive a vehicle with an expired MOT to a pre-booked MOT test at a garage. This is the only permitted use. The vehicle must not be in a dangerous condition, and your insurance must still be active.
What should I do if my MOT has already expired?
Stop driving the vehicle on public roads immediately. Book an MOT at an approved test centre as soon as possible. You can drive directly to the appointment — that journey is legal. Once you've passed, your cover is fully restored and you can also renew your vehicle tax if needed.
